1. Acceptance of Terms

By downloading, installing, or using the NomadSquad mobile application or website (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and NomadSquad ("we", "us", or "our").

2. Eligibility

To use NomadSquad you must:

• Be at least 18 years of age
• Be a human individual (automated accounts and bots are prohibited)
• Not have a previously terminated NomadSquad account
• Have the legal capacity to enter into a binding agreement

By using the Service, you represent and warrant that you meet all of the above eligibility requirements.

3. Account Registration and Responsibilities

• You must provide accurate, current, and complete information when creating your account.
• You are responsible for maintaining the security and confidentiality of your login credentials.
• You may only create and maintain one account per person.
• You must not share your account credentials with anyone.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at support@nomadsquad.app if you suspect unauthorised access to your account.

4. Prohibited Conduct

You agree not to:

• Harass, threaten, bully, stalk, or intimidate other users
• Impersonate any person, organisation, or entity
• Post or share illegal, defamatory, obscene, or harmful content
• Send unsolicited commercial messages, spam, pyramid scheme invitations, or multi-level marketing promotions
• Circumvent, disable, or interfere with any security features of the Service
• Scrape, data-mine, or use automated tools to extract data from the Service without written permission
• Upload viruses, malware, or any other malicious code
• Use the Service to facilitate any illegal activity
• Create fake profiles or misrepresent your identity or travel history

Violation of these rules may result in immediate suspension or permanent termination of your account.

5. User-Generated Content

You retain ownership of the content you post on NomadSquad (photos, messages, trip information, etc.). By posting content, you grant NomadSquad a worldwide, non-exclusive, royalty-free, sublicensable licence to use, display, reproduce, distribute, and promote that content within the Service for the purpose of operating and improving NomadSquad.

You represent and warrant that:

• You own or have the necessary rights to the content you post
• Your content does not infringe any third-party intellectual property rights
• Your content does not violate any applicable laws or these Terms

We reserve the right to remove content that violates these Terms or our Community Guidelines at any time without notice.

6. Location Sharing and In-Person Meetups

NomadSquad facilitates connections between travelers but does not independently vet, verify, or background-check any user. When meeting another traveler in person:

• You do so entirely at your own risk
• We strongly encourage you to follow our Safety Tips
• NomadSquad is not liable for any outcomes arising from in-person interactions

7. Intellectual Property

The NomadSquad name, logo, app design, and all proprietary content are owned by NomadSquad and protected by intellectual property laws. You may not:

• Copy, reproduce, or create derivative works from our platform or branding
• Use our trademarks without prior written consent
• Reverse-engineer any part of the Service

Feedback or suggestions you provide may be used by NomadSquad to improve the Service without any obligation to compensate you.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Any information provided through the Service is accurate or complete
• Defects will be corrected

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, NomadSquad and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruptions or unavailability
• Actions or conduct of other users
• Outcomes of in-person meetings arranged through the Service

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of USD $100 or the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless NomadSquad and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use or misuse of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or permanently terminate your account, without prior notice or liability, for conduct that violates these Terms or that we believe harms other users, third parties, or the integrity of the Service.

You may delete your account at any time from within the app or by contacting support@nomadsquad.app. Deletion removes your profile from the Service; certain data may be retained as required by law or for legitimate business purposes as described in our Privacy Policy.

12. NomadSquad Premium & Subscriptions

NomadSquad Premium is an auto-renewable subscription that unlocks additional features in the app. Current subscription options and pricing are displayed in the app before purchase.

• Payment: Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Auto-renewal: Your subscription automatically renews at the end of each billing period (monthly or annual, as selected) unless cancelled at least 24 hours before the renewal date.
• Cancellation: You can manage or cancel your subscription at any time in your Apple ID Account Settings (iOS) or Google Play subscriptions settings (Android). Cancelling stops future renewals; you retain access until the end of the current paid period.
• No refunds: No refund is given for any unused portion of the current subscription period upon cancellation.
• Price changes: If we change subscription pricing, we will notify you in advance. Your subscription will not renew at the new price without your consent.
• Free trials: If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand.

13. Apple App Store

The following additional terms apply if you obtained the app through the Apple App Store:

• Acknowledgement: This agreement is between you and NomadSquad only, not Apple, Inc. Apple is not responsible for the app or its content.
• Scope of licence: Your licence to use the app is a non-transferable licence to use the app on Apple-branded devices you own or control, subject to the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance and support: NomadSquad, not Apple, is solely responsible for providing maintenance and support services for the app.
• Warranty: Apple has no warranty obligation for the app. Any claims arising from failure to conform to any applicable warranty are the sole responsibility of NomadSquad.
• Product liability: NomadSquad, not Apple, is responsible for addressing any product liability or consumer protection claims relating to the app.
• Intellectual property: In the event of any third-party claim that the app infringes that party's intellectual property rights, NomadSquad, not Apple, is solely responsible for investigation, defence, settlement, and discharge of any such claim.
• Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of this agreement and, upon your acceptance of these Terms, have the right to enforce this agreement against you.
• Export compliance: You represent that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government prohibited or restricted party list.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration, except where prohibited by law.

15. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes via push notification or in-app message, and update the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
